Terms of Service

These Terms of Service govern your use of WealthFlow. Please read them carefully before accessing the Service.

1. Acceptance of Terms

By accessing or using WealthFlow ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. These terms apply to all visitors, users, and authorized agents who access the Service.

2. Description of Service

WealthFlow is a customer relationship management (CRM) platform designed for licensed financial advisors and insurance agents. The Service provides tools for managing client information, tracking investment pipelines, recording fact-finder sessions, scheduling appointments, logging communications, and automating professional outreach. The Service is intended for use by authorized professionals in the insurance and financial services industry.

3. Eligibility and Professional Use

You represent that you are a licensed professional authorized to use this Service in your jurisdiction, and that any insurance, financial, or advisory activities you conduct through WealthFlow comply with applicable licensing requirements, carrier appointments, and regulatory standards. WealthFlow is a productivity tool and does not itself provide financial, tax, legal, or insurance advice, nor does it act as a broker-dealer or insurance carrier.

4. Accounts and Access

Access to WealthFlow is granted through administrator invitation. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify the app owner immediately of any unauthorized use of your account or any other security breach. The app owner reserves the right to suspend or terminate access for inactive, terminated, or unauthorized users.

5. Client Data and Privacy

You are responsible for the accuracy and lawful collection of any client information you enter into WealthFlow, including obtaining any required consents before storing or transmitting personally identifiable, health, or financial information about your clients. You retain ownership of the client data you submit. The app owner handles data in accordance with the Service's Privacy Policy and applicable data protection laws, but you are responsible for your own compliance obligations regarding client records, including retention, sharing, and HIPAA where applicable.

6. Third-Party Integrations

WealthFlow may connect to third-party services such as Google (Gmail, Google Calendar), social platforms, marketing tools, and payment providers through OAuth and similar methods. These integrations are governed by the respective third party's terms and privacy policy in addition to these Terms. The app owner is not responsible for the practices of third-party services, and you use integrations at your own discretion.

7. Acceptable Use

You agree not to (a) use the Service for any unlawful purpose or in violation of any applicable law; (b) enter, store, or transmit data that you do not have the right or consent to handle; (c) attempt to access, disrupt, or reverse-engineer the Service's systems; (d) misuse integrations to send unsolicited communications or violate carrier/anti-spam rules; or (e) resell or sublicense access to the Service without authorization.

8. Intellectual Property

The WealthFlow software, interface, design, and documentation are the property of the app owner and its licensors, protected by intellectual property laws. Client data and content you submit remain yours. No rights to the Service are granted except as expressly provided in these terms.

9. Fees and Billing

Where applicable, access to WealthFlow may be subject to subscription fees or usage-based charges as communicated by the app owner. Fees, billing cycles, and refund terms are governed by the separate billing agreement provided at enrollment. The app owner may adjust fees with reasonable advance notice.

10. Service Availability

The Service is provided on an "as available" basis. The app owner does not guarantee uninterrupted access and is not liable for temporary outages, maintenance windows, or failures caused by third-party infrastructure. Critical features may depend on external providers (e.g., email, calendar) whose availability is outside the app owner's control.

11. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, the app owner disclaims liability for indirect, incidental, or consequential damages arising from use of the Service, including loss of client opportunities, commissions, or data. The app owner's aggregate liability is limited to the fees paid for the Service in the prior twelve months.

12. Termination

You may stop using the Service at any time. The app owner may suspend or terminate access for breach of these terms, non-payment, or where required to protect the Service or other users. Upon termination, your right to access the Service ends, and the app owner may deactivate your account and associated data in accordance with its retention policy.

13. Changes to These Terms

The app owner may update these Terms of Service from time to time. Material changes will be communicated through the Service or by other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of the jurisdiction in which the app owner operates, without regard to conflict-of-laws principles. Any disputes arising from these terms or use of the Service will be resolved in the courts of that jurisdiction.
